Privacy Policy

Welcome, and thank you for your interest in The American Electragram Company Inc., its subsidiaries and affiliates (“Electragram”, "we," or "us"), our website at Electragram.com (the "Site"), and any related web sites, networks, embeddable widgets, mobile applications (including tablet applications), and other services provided by us and on which a link to this Privacy Policy is displayed (together with the Site, our "Services"). This privacy policy (“Policy”), which is incorporated into and is subject to the Terms of Service describes the information that we gather from you on the Services, how we use and disclose such information, and the steps we take to protect such information. “Personal Information” means any information relating to an identified or identifiable individual.

This Policy explains our processing of Personal Information. Using the Services does not by itself give consent to optional browser analytics or session recordings. You can accept or reject these using Cookie preferences.

Personal Information We Collect

We may collect Personal Information from or about you or your devices from various sources, as described below. In some cases, provision of your Personal Information may be necessary to provide you with our Services. In these cases, if you fail to provide certain Personal Information when requested, we may not be able to give you access to our Services. Where required by applicable law, we indicate whether and why you must provide us with your Personal Information and the consequences of failing to do so.

A. Personal Information You Provide to Us.

Message Information. When you use the Services to send a message, we will receive your name and the name of the intended recipient, the contents of the message you send, and any other information you choose to provide in your message.

Registration and Profile Information. If you sign up for an account through email, we ask you for your name, email address, and optionally your phone number for text messages.

Contact Information. If you choose to sign up with a Google account and use the Google account address book to populate recipient addresses in your message, we will receive the names and email addresses of your contacts.

Communications. If you contact us directly, we may receive additional information about you. For example, when you contact us with an inquiry, we will receive your name, email address, and the contents of the message you send to us or any information you choose to provide.

Payment Information. If you make a purchase through our Services, your payment-related information, such as credit card or other financial information, is collected by our third-party payment processor on our behalf.

B. Personal Information We Collect When You Use Our Services.

Location Information. When you use our Services, we may infer your general location information, for example by using your internet protocol (IP) address.

Device Information. We receive information about the device and software you use to access our Services, including IP address, web browser type, and operating system version.

Your Contacts. If you permit us to give us permission to import your contacts from an email account associated with your account, we may access and store names and contact information from your address book to facilitate invitations and social interactions that you initiate through our Services and for other purposes described in this privacy policy or at the time of consent or collection. We also collect your contacts if you invite them to use our Services or share information or content with them from our Services.

Information from Cookies and Similar Technologies. We and third party partners collect information using cookies, pixel tags and similar technologies (collectively “Cookies”) about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session Cookies and persistent Cookies.

Analytics, Cookies and Session Recordings

Optional browser analytics. With your consent, we use PostHog to understand how people use our pages, identify usability problems and improve our Services. PostHog uses cookies and browser local storage to recognise a browser, associate activity with a session and remember analytics settings. The information can include pages visited, interaction and navigation patterns, dates and times, browser and device information, and online identifiers. When you are signed in, we share your account user ID, email address, role and account join date with PostHog to associate activity with your user profile. Known event guests may be associated with an event-guest identifier.

Session recordings. After you accept optional analytics, PostHog can reconstruct activity within our web pages, including page content, scrolling and interactions. This does not record your desktop, other applications, microphone or camera. Our PostHog configuration masks form inputs and selected customer-data areas, such as contact tables and conversation details, and excludes designated sensitive elements. Other rendered page text may remain visible in a recording. Recordings and related usage and error information may be analysed using automated tools to help identify problems with the Services.

Your choice. Optional browser analytics and recordings do not start until you accept. You can use the Services if you reject, and you can withdraw consent at any time using the Cookie preferences button. Withdrawal stops future optional browser capture; it does not automatically delete information already collected. You can request deletion using the contact details below. We ask for a new choice when the scope of browser tracking materially changes. Your choice is remembered in browser local storage on that site; another browser, device or site address may require a separate choice.

Essential storage. We use separate cookies and storage to provide features such as authentication, security and remembering your privacy choice. Rejecting optional analytics does not disable these functions. You can also clear cookies and local storage using your browser settings; clearing authentication cookies may sign you out.

Server-side events and error monitoring. Separately from optional browser recording, our servers send service events and technical diagnostics to PostHog to monitor operation, investigate failures and understand use of workflows. These can include login, event creation, messaging, RSVP and check-in activity, record identifiers, statuses and counts, user profile details associated with login, and technical error and request context. These are sent independently of your browser analytics choice. We rely on our legitimate interests in operating, troubleshooting and improving the Services for this processing, subject to your rights and interests. You may object by contacting us as described below.

Providers and storage. PostHog receives the information described above as a service provider. See PostHog's privacy information and its data-processing terms for provider information. Provider hosting, support and subprocessors can involve processing in other countries; the International Visitors section below applies.

Analytics retention. PostHog session recordings are retained for 30 days. Analytics events, error records and recordings held by other providers may have different retention periods. We determine how long to retain each category by its usefulness for investigating issues and improving the Services, the sensitivity of the information, and applicable legal requirements. We apply retention and deletion controls in the relevant service and review whether identifiable data remains necessary. Contact us for information about the retention applicable to your data or to exercise your rights.

C. Personal Information We Receive From Third Parties.

We may obtain Personal Information from third parties and sources other than the Services, such as publicly available sources and our partners and advertisers.

How We Use the Personal Information We Collect.

We use Personal Information we collect on the Services in a variety of ways, including for the following purposes:

When We Disclose Personal Information

We may disclose Personal Information to third parties if you consent to us doing so, as well as in the following circumstances:

We do not rent, sell, or share information about you with nonaffiliated companies for their direct marketing purposes, unless we have your permission.

Legal Bases for Processing European Personal Information

If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”), we only process your Personal Information when we have a valid “legal basis,” including as set forth below.

Your Rights and Choices

Your European Rights. If you are located in the EEA or the UK, you have the additional rights described below:

You may exercise these rights by contacting us as indicated in the “How to Contact Us” section below. Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights, and that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain Personal Information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

Marketing Communications. If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving commercial email from us by sending your request to us by email at contact@electragram.com or by writing to us at the address given at the end of this policy. We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Services.

Please be aware that if you opt out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may continue receiving promotional communications from us during that period. Additionally, even after you opt out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Services.

Contacts. You may enable or disable the sharing of contacts information by signing in to your account with Google. To disable contacts sharing from Google, follow the instructions provided by Google to “Manage third-party apps & services with access to your account.”

Third-Party Services

The Services may contain features or links to websites and services provided by third parties. Any information you provide on third-party sites or services is provided directly to the operators of such services and is subject to those operators' policies, if any, governing privacy and security, even if accessed through the Services. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through the Services. We encourage you to learn about third parties' privacy and security policies before providing them with information.

Retention

We take measures to delete your Personal Information or keep it in a form that does not permit identifying you when your Personal Information is no longer necessary for the purposes for which we process it unless we are required by law to keep your Personal Information for a longer period. When determining the specific retention period, we consider various factors, such as the type of service provided to you, the nature and length of our relationship with you, and mandatory retention periods provided by law and the statute of limitations.

Children's Privacy

We do not knowingly collect Personal Information from children under the age of 13 and no part of our Services are directed to children. If you learn that a child has provided us with Personal Information, please contact us as indicated in the “How to Contact Us” section below.

Security

We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of Personal Information that we collect and maintain. Please be aware that no security measures are perfect or impenetrable and thus, we cannot guarantee the 100% effectiveness of our physical, technical, or managerial safeguards.

International Visitors

Our Services are hosted in the United States and we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. Where EEA or UK data-protection law applies, international transfers require an applicable legal mechanism, such as an adequacy decision or appropriate contractual safeguards. Your acceptance of optional analytics is not a substitute for those transfer requirements. Contact us for details of the safeguards applicable to your Personal Information.

Update Your Information

You can update your account and profile information through your account settings.

Changes to this Privacy Policy

Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time. If we modify this Policy, we will make it available through the Services, and indicate the date of the latest revision. In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change. For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the Service for the first time after such material changes are made. Where a change requires fresh consent, we will ask for it; continued use of the Services does not by itself provide that consent.
